Please read these Terms of Service ("Terms") carefully before using the Graphgpt application (the "Service") operated by Graphgpt ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

3. User Data and Privacy

Your privacy is critically important to us. Our data handling practices are detailed in our Privacy Policy, which is an integral part of these Terms. We do not store or share your data without your explicit consent, as outlined in the Privacy Policy.

4. Intellectual Property and Trademark

The "GPT" component of Graphgpt stands for Generate - Project - Transform and must not be interpreted as referencing OpenAI’s proprietary GPT products.

Graphgpt does not claim ownership of or association with OpenAI, ChatGPT, or any registered GPT trademarks.

All data, visuals, and features within Graphgpt operate through independent computation frameworks and comply with relevant global intellectual property laws.

5. Subscriptions, Payments, and AI Credits

Parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").

A. Plans and AI Credits

"AI Credits" are units used to access specific features, such as "Generate with AI" and "Import file to generate graph." Standard manual graphing and annotation features do not consume AI Credits.

• Free Plan: Users receive 50 AI Credits upon signing up. This plan includes access to all 2D, 3D, & Stats Graphing features, Live Annotation Tools, and Cloud Sharing & Embedding.
• Plus Plan: For a recurring monthly fee (₹99/mo), users receive 3,000 AI Credits per month, all features from the Free Plan, and Priority Support.
• Pro Plan: For a recurring monthly fee (₹199/mo), users receive 7,000 AI Credits per month, all features from the Plus Plan.
• Max Plan: For a recurring monthly fee (₹399/mo), users receive 14,000 AI Credits per month, all features from the Pro Plan (excluding Priority Support, which is already included).

AI Credits reset at the beginning of each Billing Cycle and do not roll over.

B. Payment Processing

We use a third-party payment processor (e.g., Razorpay) to handle all payment transactions. By providing payment information, you agree that we may share this information with the payment processor. We do not store or collect your full payment card details.

C. Renewals & Cancellations

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal through your account settings page.

D. Fee Changes

Graphgpt, in its sole discretion and at any time, may modify the Subscription fees. Any fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in fees.

6. Use of the Service

You are granted a non-exclusive, non-transferable, revocable license to access and use the Service strictly in accordance with these Terms.

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation.
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service.
• To reverse-engineer, decompile, or disassemble any portion of the Service.

7. Content

A. User-Generated Content

You retain ownership of any data or content you submit to the Service ("User Content"). By providing User Content (e.g., by clicking "Share"), you grant us a worldwide, non-exclusive, royalty-free license to use and store this content *solely* for the purpose of operating and providing the Service to you, as described in our Privacy Policy.

B. AI-Generated Content

The Service uses artificial intelligence to generate graphs, functions, and analysis ("AI Content"). This AI Content is provided for informational purposes only. While we strive for accuracy, we make no guarantees as to the correctness, completeness, or reliability of AI Content. You are responsible for verifying the accuracy of any information provided by the AI before relying on it.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk.

10. Limitation of Liability

In no event shall Graphgpt, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
